Terms & Conditions
Last updated July 2026
1. About This Website
This website is operated by Dr Daniel Pearl BSc MBBS PhD MRCP, a Consultant
Gastroenterologist and General Physician offering private medical consultancy services. By accessing or using this website, you agree to be bound by these Terms of Use. If you do not agree, please do not use this website.
2. Nature of Information Provided
The information on this website is intended for general informational purposes only. It does not constitute medical advice, diagnosis, or treatment, and should not be relied upon as such. Nothing on this website creates a doctor–patient relationship. A doctor–patient relationship is established only once you attend, or are accepted for, a private consultation. If you have a medical concern, you should consult a qualified healthcare professional. In an emergency, call 999 or attend your nearest Accident & Emergency department immediately.
3. Private Consultation Services
3.1 Referral and Booking
Private consultations are arranged through the Private Patients Unit at Parkside, Somerset NHS Foundation Trust, by referral from your GP or another healthcare professional, or by self-referral where clinically appropriate. Booking is subject to acceptance and clinical appropriateness. Dr Pearl reserves the right to decline or redirect enquiries where this is clinically or
professionally appropriate.
3.2 Scope of Service
Consultations are provided within the specialty of gastroenterology and general internal medicine. Dr Pearl practises within the limits of his competence (scope of practice) and in accordance with GMC Good Medical Practice. Where a clinical matter falls outside his scope of practice, he will advise you accordingly and, where appropriate, refer you to a suitable colleague. It may not be apparent that a clinical problem falls outside his scope of practice until after the professional relationship has started (effectively following his acceptance of the referral).
3.3 Fees and Payment
Billing for your care is arranged as follows:
-
Tests, procedures, and facility charges are billed by Somerset NHS Foundation Trust, either directly to your insurer or to you if you are self-paying.
-
Consultation fees are invoiced by Pearl Medical Consultancy Ltd: directly to self-pay patients, and to insured patients where a shortfall exists between the insurer’s payment and the fee charged.
If you hold private medical insurance, it is your responsibility to verify your policy
entitlement and obtain any required pre-authorisation in advance. You will be liable for the full costs of treatment if pre-authorisation is not obtained. Dr Pearl is fee assured with most recognised insurers; this means that he charges in line with their policies. However, if you proceed with consultations or medical investigations without pre-authorisation, you may be charged the "self-pay" rate. As with all insurance, you will be responsible for all costs not met by your insurers, including any and all shortfalls that become due once your insurer is invoiced. Your medical insurance policy details will detail what costs you are responsible for.
3.4 Cancellation
Please give as much notice as possible if you need to cancel or rearrange an appointment. If you fail to attend the appointment, you will be charged the full cost of the appointment. If you cancel within 24 hours, you will be charged 50% of the cost of the appointment.
4. No Substitute for Emergency Care
This website and the consultation services described on it are not appropriate for medical emergencies. If you believe you are experiencing a medical emergency, do not contact this practice — call 999 or go immediately to your nearest A&E department.
5. Intellectual Property
All content on this website — including text, layout, and structure — is the property of Dr Daniel Pearl or used with permission, and is protected by applicable copyright and
intellectual property law. You may not reproduce, distribute, or republish any content
without prior written consent.
6. Third-Party Links and Website Hosting
This website may be hosted via a third-party platform and may contain links to
third-party websites, such as professional bodies or patient information resources. These links are provided for convenience only. Neither Dr Pearl nor the Practice endorses, controls, or accepts responsibility for the content of any linked external site or the technical operation of the hosting platform.
7. Liability and Indemnity
7.1 Website Content
To the fullest extent permitted by law, neither Dr Pearl nor Pearl Medical Consultancy Ltd. accepts liability for any loss or damage arising from your use of, or reliance on, information contained on this website. This does not affect any liability that cannot be excluded under English law.
7.2 Clinical Care
Clinical care provided during your private consultation is covered by Dr Pearl’s
personal professional indemnity arrangements, and not by Somerset NHS Foundation Trust’s indemnity scheme, except where any element of your
care is provided directly by Trust employees acting within the scope of their Trust
employment (for example, nursing or diagnostic staff), in which case Trust indemnity
arrangements apply to that element of care.
7.3 Premises and Facilities
Somerset NHS Foundation Trust, as occupier of the premises at which the private work is conducted, is responsible for the safety and proper maintenance of those premises and facilities, and for the acts and omissions of its employed staff acting in their employed capacity. Dr Pearl has no control over, and accepts no liability for, the condition, maintenance, or safety of the premises used for private work, or for any personal injury sustained by a patient on those premises during their private care which arises from the state of the premises or the acts or omissions of Trust staff, rather than from Dr Pearl’s own clinical care. Dr Pearl's use of these facilities for private work is not an indicator of his acceptance of the suitability of these premises for private work; Somerset NHS Foundation Trust has declared that these sites are suitable for private work. Any claim concerning the condition or safety of the premises, or the acts or omissions of Trust staff, should be directed to Somerset NHS Foundation Trust.
7.4 Other Clinicians, Reporting Services, and Third-Party Information
Where Dr Pearl refers you for tests or investigations (for example, radiology,
histopathology, or other diagnostic services), these may be reported by other clinicians, whether practising privately in their own right or acting as employees of Somerset NHS Foundation Trust. Dr Pearl accepts no liability for any error, omission, or clinical harm arising from the reporting or performance of such tests or investigations by those other clinicians or Trust staff. Responsibility for the accuracy and quality of such reporting rests with the clinician or service that produced it, and, where applicable, with their employer or indemnifying body. This includes, for example, a radiology reporting error, or clinical harm arising from a radiology test or procedure carried out by an NHS employee of the Trust acting in that
capacity, or reported by a private clinician. Where Dr Pearl makes clinical decisions — including decisions regarding your ongoing care, treatment, or management — on the basis of information, results, or reports provided to him by other clinicians or healthcare providers, he accepts no liability for any harm arising from those decisions where those decisions were made in good faith and in reasonable reliance on that
information, and where the information subsequently proves to have been inaccurate,
incomplete, or misleading due to an error on the part of the provider who supplied it. In such circumstances, responsibility rests with the clinician or service that provided the inaccurate information. Nothing in this clause excludes or limits liability for death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
8. Privacy and Data Protection
Your personal data is processed in accordance with the UK GDPR and the Data Protection Act 2018. Clinical and administrative data relating to your care is controlled by Somerset NHS Foundation Trust; certain non-clinical correspondence is controlled by Pearl Medical Consultancy Ltd. Please refer to the separate Privacy Policy on this website for full details, including who to contact for different types of query.
9. Regulatory Status
Dr Daniel Pearl is registered with and regulated by the General Medical Council (GMC) number 4637086. He holds a licence to practise and is bound by the GMC’s professional standards and guidance, including Good Medical Practice. Private consultations take place at the Private Patients Unit, Parkside, operated by Somerset NHS Foundation Trust, which is regulated by the Care Quality Commission (CQC).
10. Governing Law
These Terms of Use are governed by and construed in accordance with the law of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

These Terms of Use may be updated from time to time. The date at the top of this page indicates when they were last revised. Continued use of this website following any update constitutes acceptance of the revised terms.
